Nuremberg Principles

The Nuremberg principles were a set of guidelines for determining what constitutes a war crime. The document was created by the International Law Commission of the United Nations to codify the legal principles underlying the Nuremberg Trials of War Criminals of World War II.


Principle I

Principle I states, "Any person who commits an act which constitutes a crime under international law is responsible therefore and liable to punishment."
Principle II

Principle II states, "The fact that internal law does not impose a penalty for an act which constitutes a crime under international law does not relieve the person who committed the act from responsibility under international law."
Principle III]

Principle III states, "The fact that a person who committed an act which constitutes a crime under international law acted as Head of State or responsible government official does not relieve him from responsibility under international law."
Principle IV
Main article: Superior Orders

Principle IV states: "The fact that a person acted pursuant to order of his Government or of a superior does not relieve him from responsibility under international law, provided a moral choice was in fact possible to him".

This principle could be paraphrased as follows: "It is not an acceptable excuse to say 'I was just following my superior's orders'".

Previous to the time of the Nuremberg Trials, this excuse was known in common parlance as "Superior Orders". After the prominent, high profile event of the Nuremberg Trials, that excuse is now referred to by many as "Nuremberg Defense". In recent times, a third term, "lawful orders" has become common parlance for some people. All three terms are in use today, and they all have slightly different nuances of meaning, depending on the context in which they are used.

Nuremberg Principle IV is legally supported by the jurisprudence found in certain articles in the Universal Declaration of Human Rights which deal indirectly with conscientious objection. It is also supported by the principles found in paragraph 171 of the Handbook on Procedures and Criteria for Determining Refugee Status which was issued by the Office of the United Nations High Commissioner for Refugees (UNHCR). Those principles deal with the conditions under which conscientious objectors can apply for refugee status in another country if they face persecution in their own country for refusing to participate in an illegal war.
Principle V]

Principle V states, "Any person charged with a crime under international law has the right to a fair trial on the facts and law."
Principle VI]

Principle VI states,

"The crimes hereinafter set out are punishable as crimes under international law:(a) Crimes against peace:(i) Planning, preparation, initiation or waging of a war of aggression or a war in violation of international treaties, agreements or assurances;(ii) Participation in a common plan or conspiracy for the accomplishment of any of the acts mentioned under (i).(b) War crimes:Violations of the laws or customs of war which include, but are not limited to, murder, ill-treatment or deportation to slave labor or for any other purpose of civilian population of or in occupied territory; murder or ill-treatment of prisoners of war or persons on the Seas, killing of hostages, plunder of public or private property, wanton destruction of cities, towns, or villages, or devastation not justified by military necessity.(c) Crimes against humanity:Murder, extermination, enslavement, deportation and other inhumane acts done against any civilian population, or persecutions on political, racial, or religious grounds, when such acts are done or such persecutions are carried on in execution of or in connection with any crime against peace or any war crime."
Principle VII]

Principle VII states, "Complicity in the commission of a crime against peace, a war crime, or a crime against humanity as set forth in Principle VI is a crime under international law."

From Iraq, A Tragic Reminder To Prosecute The War Criminals

May 27, 2013 "Information Clearing House" - The dust in Iraq rolls down the long roads that are the desert's fingers. It gets in your eyes and nose and throat; it swirls in markets and school playgrounds, consuming children kicking a ball; and it carries, according to Dr. Jawad Al-Ali, "the seeds of our death". An internationally respected cancer specialist at the Sadr Teaching Hospital in Basra, Dr. Ali told me that in 1999, and today his warning is irrefutable. "Before the Gulf war," he said, "we had two or three cancer patients a month. Now we have 30 to 35 dying every month. Our studies indicate that 40 to 48 per cent of the population in this area will get cancer: in five years' time to begin with, then long after. That's almost half the population. Most of my own family have it, and we have no history of the disease. It is like Chernobyl here; the genetic effects are new to us; the mushrooms grow huge; even the grapes in my garden have mutated and can't be eaten."
 

Along the corridor, Dr. Ginan Ghalib Hassen, a paediatrician, kept a photo album of the children she was trying to save. Many had neuroplastoma. "Before the war, we saw only one case of this unusual tumour in two years," she said. "Now we have many cases, mostly with no family history. I have studied what happened in Hiroshima. The sudden increase of such congenital malformations is the same."

Among the doctors I interviewed, there was little doubt that depleted uranium shells used by the Americans and British in the Gulf War were the cause. A US military physicist assigned to clean up the Gulf War battlefield across the border in Kuwait said, "Each round fired by an A-10 Warhog attack aircraft carried over 4,500 grams of solid uranium. Well over 300 tons of DU was used. It was a form of nuclear warfare."

Although the link with cancer is always difficult to prove absolutely, the Iraqi doctors argue that "the epidemic speaks for itself". The British oncologist Karol Sikora, chief of the cancer programme of the World Health organisation (WHO) in the 1990s, wrote in the British Medical Journal: "Requested radiotherapy equipment, chemotherapy drugs and analgesics are consistently blocked by United States and British advisers [to the Iraq Sanctions Committee]." He told me, "We were specifically told [by the WHO] not to talk about the whole Iraq business. The WHO is not an organisation that likes to get involved in politics." 

Recently, Hans von Sponeck, the former assistant secretary general of the United Nations and senior UN humanitarian official in Iraq, wrote to me: "The US government sought to prevent WHO from surveying areas in southern Iraq where depleted uranium had been used and caused serious health and environmental dangers." 

Today, a WHO report, the result on a landmark study conducted jointly with the Iraqi Ministry of Health has been "delayed". Covering 10,800 households, it contains "damning evidence", says a ministry official and, according to one of its researchers, remains "top secret". The report says that birth defects have risen to a "crisis" right across Iraqi society where DU and other toxic heavy metals were by the US and Britain. Fourteen years after he sounded the alarm, Dr. Jawad Al-Ali reports "phenomenal" multiple cancers in entire families.

Iraq is no longer news. Last week, the killing of 57 Iraqis in one day was a non-event compared with the murder of a British soldier in London. Yet the two atrocities are connected. Their emblem might be a lavish new movie of F. Scott Fitzgerald's The Great Gatsby. Two of the main characters, as Fitzgerald wrote, "smashed up things and creatures and retreated back into their money or their vast carelessness... and let other people clean up the mess". 

The "mess" left by George Bush and Tony Blair in Iraq is a sectarian war, the bombs of 7/7 and now a man waving a bloody meat cleaver in Woolwich. Bush has retreated back into his Mickey Mouse "presidential library and museum" and Tony Blair into his jackdaw travels and his money. 

Their "mess" is a crime of epic proportions, wrote Von Sponeck, referring to the Iraqi Ministry of Social Affairs' estimate of 4.5 million children who have lost both parents. "This means a horrific 14 per cent of Iraq's population are orphans," he wrote. "An estimated one million families are headed by women, most of them widows". Domestic violence and child abuse are rightly urgent issues in Britain; in Iraq the catastrophe ignited by Britain has brought violence and abuse into millions of homes.

In her book 'Dispatches from the Dark Side', Gareth Peirce, Britain's greatest human rights lawyer, applies the rule of law to Blair, his propagandist Alastair Campbell and his colluding cabinet. For Blair, she wrote, "human beings presumed to hold [Islamist] views, were to be disabled by any means possible, and permanently... in Blair's language a 'virus' to be 'eliminated' and requiring 'a myriad of interventions [sic] deep into the affairs of other nations.'" The very concept of war was mutated to "our values versus theirs". And yet, says Peirce, "the threads of emails, internal government communiques reveal no dissent".

For Foreign Secretary Jack Straw, sending innocent British citizens to Guantanamo was "the best way to meet our counter terrorism objective". These crimes, their iniquity on a par with Woolwich, await prosecution. But who will demand it? In the kabuki theatre of Westminster politics, the faraway violence of "our values" is of no interest. Do the rest of us also turn our backs?

The British Government's police force in British Occupied Ireland secretly still runs "death squads"along with the British state sponsored terror  organisation "the Committee,"  to assassinate innocent Irish people and block a united Ireland. A member of this Committee testified about the murders, admitting publicly, the 'Committee' was composed of fifty to sixty people, using two professional assassins, "The Jackal" and "King Rat," to murder those, the British judged enemies of the British Occupation of Ireland's 6 north-eastern counties. The two assassins were usually guided to targets by the British and their police, ensuring the British murders would always remain officially "unsolved."

Examples of British Government Murders in Ireland ;

* the bomb attacks on Dublin and Monaghan in May 1974, when thirty-three people were murdered. British state terror squads had driven their bombs across the border from Armagh into the Irish state. The Dublin bombs were detonated, during peak rush hour to cause maximum kills of Irish people. The bombs were assembled by serving British policeman, the explosives supplied by a member of a British Army Regiment, working closely with British Military Intelligence. Those involved have been named.

 

* bomb and machine-gun attacks on native Irish, were carried out by British police and British army officers, causing many deaths to innocent civilians on both sides of the Irish border. 

* the notorious British mentored loyalist assassin Robin Jackson, "The Jackal," was responsible for the murder of more than a 100 people, while protected and "handled" by British secret police. As a result, nearly all of Jackson's  murders remain offficially "unsolved." 

* some of the most notorious British atrocities and murders of Irish people remain "unsolved" committed by British police. One of these killers Mark Fultonm is a nephew of David and Albert Prentice, members of the Committee of sponsors of British state terror

The British Government has done everything possible to prevent the truth about these scandals ever becoming public.The United Nations Rapporteur's demand for an independent inquiry into the murder of human rights lawyer Pat Finucane, has been refused; by successive Labour and Tory British governments. Subsequently another brave and brilliant human rights lawyer, Rosemary Nelson the single most effective crusader for justice within the notorious "murder triangle," of Lurgan, County Armagh was murdered by a sponsored British State terror squad. Rosemary was a relentless truth seeker, dedicated to her clients as a legal representative for the families of many victims of British State death squads such as Denis Carville, Sam Marshall, Rory and Gerard Cairns, Katrina Rennie, Eileen Duffy and Brian Frizzell.

Rosemary was murdered by the British, when a bomb exploded under her car. This barbarous British Goernment act, ended the life of a loving, devoted professional, who exposed the truth about British Government collusion with their death squads in Ireland. Again like the murder of Pat Finucane, the British Government will not conduct a genuine independent inquiry into her murder, ensuring historic hatreds, poisoning the minds and hearts of young people, until everyone eventually like Bloody Sunday, they are forced to confront terrible deeds done. Only after revelations of truth with justice, can Irish republicans, loyalists, the British police, the British army, secret services and forces achieve a real prospect of forgiveness, reconciliation and peace. The recent British Tory administration, are hell bent on continuing their war in Ireland for their industrial war complex and as justification for bloated secret service budgets and increased secret service, gestapo like, powers.

The British authorities frequently condemn human rights abuses by the People's Republic of China and in other countries around the world, while breaking the terms and their undertakings to a peace process in Ireland. There is considerable independent evidence, uncovered about serious human rights abuses much closer to home, which they formerly boasted, was as British as Finchley. If they were even bothered to look at considerable authentic video and audio tape-recordings of a self-confessed Committee member, explaining, in great detail, how British police helped the Committee, to run British "death squads" in Ireland No they will instead put their energy into burying the truth about these murders, misleading the public about British police roles in political assassination in British Occupied  Ireland,  interning without trial, political protest of conscience, thus censoring the remaining witnesses to the deeds of their war criminals, at the highest level. Those who do not remember their past are condemned to repeat it.That is the law of nature. Ireland is still contaminated by a Nazi past and is about to elect a Nazi Government of Fine Gael and repeat its past. The Germans processed their past. The French jailed their Vichy collaborators who deported Jews to concentration camps. Cambodians have been truthful about their Pol Pot regime. The Irish have NOT been honest about their Irish Nazi Fine Gael past, particularly of 1922-23.

After centuries of the colonial British, cultivating divisions among the Irish and conquering Ireland, it became a Nazi British compliant state in 1922. The servant leadership of the British left behind, descended into Nazism which and was particularly brutal. From mid 1922, the founders of Fine Gael, did barbaric war crimes to other Irishmen. The Fine Gael massacre at Ballyseedy in County Kerry, symbolizes those war crimes against their own people. Offically Fine Gael was founded, following a merger of Cumann na nGaedheal, the National Centre Party and the "Blueshirts". Its real origins however were the British armed pro-Treaty Fascist side in the Irish Civil War.

Five soldiers of this British armed compliant scum state which included an infamous torturer of prisoners of war, were killed by a booby trap bomb of republicans at Cnoc na gCaiseal. In retaliation, the British armed soldiers chained a number of already captured, prisoners of war around a bomb at Ballyseedy Cross and detonated it. Most of the prisoners lived past the initial explosion.The Fine Gael, British armed soldiers then fired British grenades at groaning, half-butchered Irish republican prisoners to kill them off.


The birds were eating human flesh off the trees in Ballyseedy for days afterwards. There was no way of telling, how many prisoners were butchered and as result, they sent the wrong number of coffins came back to Tralee next day. In fact 8 prisoners of war were butchered by the founders of Fine Gael that night at Ballyseedy. The people of Tralee did not know what to do with the extra coffin. A mother cried: “But my son was six feet tall. How can he come home to me in such a small coffin?" She was not permitted to open the coffin.


On that very morning in 1922, noble leaders of the Easter Rising, Rory o'Connor, Liam Mellows, Richard Barret and Joseph McKelvey were also murdered by the Irish Nazi founders of the Fine Gael regime in Mountjoy Gaol. That set the pattern of cause and effect of the Irish Nazi Fine Gael government that followed which in turn was to set the example, for Hitler’s Nazis during World War II. Thus the Irish Nazi founders of Fine Gael, then in a British compliant governement of 1922-23, set the example for twentieth century Europe. When German Nazis razed a whole village to the ground, with all of its people, for the assassination of Reinhart Heydrich, they were copying the tactics of the Irish Nazi Fine Gael founders of 1922-23.

Fine Gael are more British than the British themselves and are even worse dictators than the British were. The most brutal tyrants of Ireland are her own Fine Gael countrymen. Irish Nazism is glossed over in Irish history.There should have been and should still be  and Irish equivalent of Nuremberg trials for war crimes against Fine Gael. A witness lived to tell the tale, Stephen Fuller would have identified the Fine Gael war criminals who set off the blast, and then hurled grenades at moaning, dying, butchered men to finish them off. The Fine Gael war criminals were never prosecuted, because Eamon de Valera’s was ordered by British masters of compliant scum state to keep the whole thing under wraps. Dev was all that was left when all thedecent Irishmen with leadership qualities were killed off between 1916-1923.He was by default all that was left.


THOSE WHO DO NOT REMEMBER THE PAST ARE CONDEMNED TO REPEAT IT. That is a law of nature.
